This Privacy Policy explains how MightyInk LLC (“MightyInk,” “we,” “us,” or “our”) collects, uses, discloses, stores, and deletes information when you use the MightyInk mobile application, web application, public sharing pages, and related services (collectively, the “Service”).

1. Who the Service Is For

MightyInk is a family content-creation service intended to be registered and managed by a parent, legal guardian, or other authorized adult who is at least 18 years old. Adults may provide information about children so the Service can create personalized characters, stories, songs, illustrations, narration, and related content.

Children may use the Service only with the authorization and supervision of a parent or legal guardian. We do not intend for children to create or independently manage accounts. The adult account holder is responsible for supervising use of the Service and for having authority to provide information, photos, recordings, and other content about every person represented.

If you believe a child provided personal information without appropriate adult authorization, contact us using the information in Section 15.

2. Information We Collect

We may collect the following categories of information:

Some information, including information about children, photos, faces, and voice recordings, may be considered sensitive personal information under applicable law. We use this information only for the purposes described in this Policy, including providing features requested by the adult account holder, operating and securing the Service, and complying with law. We do not use it for third-party behavioral advertising.

3. How We Collect Information

We collect information:

• directly from you when you create an account, enter information, upload content, record audio, make selections, communicate with us, or use the Service;
• automatically from your device and use of the Service, including through logs, cookies or similar technologies, app diagnostics, and security systems;
• from Apple, Google, RevenueCat, or another applicable platform when you sign in, subscribe, make a purchase, restore purchases, or receive an entitlement; and
• from another authorized family member when that person invites you, adds you to a family, or shares content with you.

4. How We Use Information

We use information to:

• create and secure accounts, authenticate users, and manage family membership;
• create and personalize characters, avatars, stories, songs, illustrations, narration, voices, and related media;
• operate family, friend, sharing, favorites, history, archive, and notification features;
• process subscriptions, credits, gift codes, purchase restoration, refunds, reversals, and fraud or duplicate-purchase controls;
• cache and deliver media, synchronize content across devices, and support limited offline use;
• provide support and transactional messages, including verification, password-reset, welcome, generation, sharing, and account notices;
• monitor reliability, investigate errors, enforce limits and safety rules, prevent abuse, secure the Service, and maintain audit and operational records;
• comply with law and protect the rights, safety, and integrity of users, MightyInk, and others; and
• analyze and improve Service quality and generation performance.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising or use personal information for third-party behavioral advertising.

5. AI and Media Processing

To produce content you request, MightyInk may send relevant inputs to AI and media providers. Depending on the feature and current configuration, these inputs may include prompts, story or song text, character details, uploaded or generated reference images, voice samples, and requested style or audio settings. Providers return outputs to MightyInk, and those outputs may be stored with your family’s content.

Current or conditionally available providers include:

• OpenAI for text and image generation;
• Anthropic for text generation and supporting text tasks;
• Google Gemini for image generation when that provider is selected;
• ElevenLabs for narration, voice cloning, sound, and music generation; and
• Mureka as a conditional song-music provider.

Not every provider processes every request, and provider availability and models may change. These providers process information to supply services to MightyInk under their applicable terms, privacy notices, and contractual commitments.

6. Other Service Providers and Disclosures

We disclose information to service providers as reasonably necessary to operate the Service, including:

• Google Cloud Storage for uploaded and generated media and operational archives;
• PostgreSQL and Neon for application, account, session, content, commerce, and operational records;
• RevenueCat, Apple App Store, and Google Play for subscriptions, purchases, entitlements, restoration, refunds, and transaction verification;
• Apple and Google when you use their sign-in services;
• Resend for transactional email;
• Expo and the applicable device platform for push notifications;
• Render and other infrastructure used to host and deliver the Service; and
• monitoring, security, logging, and support providers, such as Better Stack.

We require service providers that receive personal information from us to protect it and process it only for authorized purposes. We may also disclose information:

• when required by law, legal process, or a valid government request;
• to protect the rights, property, safety, or security of users, MightyInk, or others;
• to investigate fraud, abuse, security incidents, or violations of our Terms; or
• in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of our business or assets, subject to applicable law.

7. Family, Friend, and Public Sharing

• Family sharing. Family members can access family content and may share pooled subscription benefits and credits. Anyone with a valid invite code may be able to join the family, so share invite codes carefully.
• Friend sharing. Approved friend families may receive characters, stories, songs, requests, or notifications according to the sharing action and product settings.
• Public links. If you create a public story or song link, anyone who receives or obtains the link may view or play the shared content without signing in. Link-preview services and social platforms may fetch the title, character names, cover or social image, and related metadata. Revoking or rotating a link prevents future access through that link but cannot recall copies, screenshots, downloads, caches, or onward sharing already made by recipients or third parties.

Before sharing, review the content for names, faces, voices, or other information you do not want recipients to see.

8. Children’s Privacy and Parental Choices

MightyInk is designed to be controlled by an adult. We do not knowingly allow a child to create or independently manage an account. An adult may choose to provide a child’s name, age or age range, physical or character descriptions, relationships, photos, voice recordings, story or song ideas, and generated content so MightyInk can provide the requested family content features.

The adult account holder represents that they are the child’s parent or legal guardian or otherwise have authority to provide and authorize the use of the child’s information. Where applicable law requires parental consent, we will seek consent before collecting, using, or disclosing a child’s personal information beyond an applicable legal exception.

A verified parent or legal guardian may contact us to:

• review the types of personal information associated with their child;
• request correction or deletion of that information;
• revoke consent and prevent further collection or use; or
• ask questions about our child-related information practices.

We may verify the requester’s identity and authority before acting. Revoking consent or deleting information that is necessary for a feature may make that feature or related content unavailable. We collect and retain child-related information only as reasonably necessary to provide the requested Service, protect the Service and its users, or comply with law.

9. Storage, Security, and Local Caching

Application records are stored in databases. Uploaded and generated media, such as photos, avatars, illustrations, narration, songs, and sharing images, are generally stored in object storage and referenced by database records.

We use administrative, technical, and physical safeguards designed to protect information, including password hashing, server-managed sessions, access controls, authorized media access, rate limits, and operational monitoring. No system is completely secure, and we cannot guarantee that information will never be lost, misused, or accessed without authorization.

The app stores settings, identifiers, and cached content on your device. Cached images, story content, narration, and song audio may remain after sign-out so the same family can load content faster or use supported offline features. Changing to a different family, removing the app, using operating-system storage controls, or clearing the cache may remove some local data. Public-link previews and third parties may maintain separate caches outside our control.

10. Retention and Deletion

We retain personal information only for as long as reasonably necessary for the specific purposes described in this Policy, including providing the Service, maintaining account and family features, completing transactions, complying with law, resolving disputes, preventing fraud and abuse, and protecting the Service. Retention periods vary by record type, sensitivity, operational need, and legal requirements.

• Content generally remains until an authorized user deletes it, the associated account or family is deleted, or it is removed under our rules.
• Deleting an account initiates deletion of associated application records and media within the scope of that account. Family content or records belonging to remaining family members may remain.
• Object-storage cleanup may continue after database deletion. Temporary caches, security and operational logs, transaction records, legal records, and backups may remain for a limited period or as required by law.
• Third-party providers and recipients of shared content may retain information under their own policies or because a recipient copied or reshared it.

We securely delete or de-identify personal information when it is no longer reasonably necessary, subject to legal, security, fraud-prevention, backup, and transaction-record obligations. Deleting the app or signing out does not delete your account. Use Delete Account in Settings or contact us for assistance.

11. Notifications and Communications

With your permission, we use push tokens to send generation, family, friend, sharing, request, and failure notifications. You can disable push notifications in your device settings. We may send transactional emails needed for account security and operation. If we send marketing communications, we will provide the opt-out choices required by applicable law.

12. Your Choices and Privacy Rights

You can update certain account, family, character, sharing, notification, and content settings in the app; revoke supported public links; delete supported content; and delete your account.

Depending on where you live, you may have rights to request access, correction, deletion, restriction, objection, or portability; withdraw consent; opt out of certain disclosures or processing; appeal a decision; or complain to a regulator. We do not discriminate against you for exercising a privacy right.

Submit a request using the information in Section 15. We may need to verify your identity and your authority over a family or child’s information. We will respond within the period required by applicable law.

13. International Processing

MightyInk and its providers may process information in countries other than where you live, including the United States. Those countries may have different data-protection laws. Where required by law, we use recognized safeguards for international transfers, such as contractual protections or another legally authorized transfer mechanism.

14. Legal Bases for Processing

Where applicable law requires a legal basis, we process personal information as necessary to perform our contract with you; based on consent, including consent for device permissions and certain sensitive information; for legitimate interests such as operating, securing, supporting, and improving the Service; and to comply with legal obligations. You may withdraw consent where processing is based on consent, but withdrawal does not affect processing already completed and may make some features unavailable.

16. Changes to This Policy

We may update this Policy as the Service, our practices, or applicable law changes. We will post the revised Policy and update the date above. Where required, we will provide additional notice or request consent before a material change takes effect.
